AB 5 Construction Trucking Exemption to Expire Soon 

WHAT: Guidance for contractors on a major shift in compliance for trucking services

In 2019, AB 5 codified the Dynamex decision, which shifted the burden to “the hiring entity” to determine whether an individual is an independent contractor or an employee, as well as establishing “the ABC test” for determining that. At the time, UCON, along with other construction associations, successfully negotiated an exemption from the ABC test for the construction industry. However, this exemption will expire on January 1, 2025, leaving construction contractors with a very challenging situation.

UCON and AGC have issued a joint memo detailing our attempts to further extend AB 5 and preliminary recommendations from legal counsel. Any contractor who uses construction trucking services needs to read this memo and begin your action plan.
